Welcome to Creation The Creator ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, services, and any related platforms (collectively, the "Services"). Our Services specialize in custom metal fabrication, including laser cutting, laser CNC machining, laser welding, laser rust removal, and bespoke metal works, as well as our online product shop for ready-made items. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Your use of the Services constitutes your agreement to these Terms and our Privacy Policy. We reserve the right to update these Terms at any time, and continued use after changes signifies your acceptance. It is your responsibility to review these Terms periodically.

2. Description of Services

We provide precision metal fabrication services tailored to your specifications, including custom designs, prototypes, repairs, and production runs. Our product shop offers pre-made metal items and accessories. All services are performed with high-quality materials and craftsmanship, but final outcomes may vary based on project complexity and provided specifications.

3. Ordering and Payment

For custom orders, full payment is required upfront before we commence work. Pricing is provided via personalized quotes after we assess the project scope. Payments are processed securely through your customer account. We accept major credit cards and other methods as specified. All prices are in USD and exclude taxes, shipping, and handling fees unless otherwise stated.

4. Cancellation and Refunds

Custom orders cannot be canceled once supplies have been ordered or production has begun. If cancellation is requested prior to that point, we may issue a refund minus any administrative fees. Refunds for shop products are subject to our return policy, available on the product shop page. We are not responsible for delays due to supply chain issues, force majeure, or other unforeseen circumstances.

5. Submitted Materials and Intellectual Property

Any images, files, designs, or other materials ("Submitted Materials") you provide via our contact form, email, or other channels will be used solely for the project to which they relate. You represent that you own or have rights to the Submitted Materials and grant us a limited, non-exclusive license to use them for fulfilling your order. We retain ownership of our processes, techniques, and any modifications we make unless otherwise agreed in writing. You agree not to submit materials that infringe third-party rights.

6. Shipping and Delivery

We ship products and completed custom orders via reliable carriers. Shipping costs and timelines are estimated during quoting. We are not liable for delays, loss, or damage during transit. Title and risk of loss pass to you upon shipment. International orders may incur additional duties and taxes, which are your responsibility.

7. Warranties and Disclaimers

We warrant that our Services will be performed in a professional manner consistent with industry standards. However, we make no warranties regarding fitness for a particular purpose or merchantability beyond what is expressly stated. All Services are provided "as is," and we disclaim any implied warranties to the fullest extent permitted by law.

8. Limitation of Liability

In no event shall we be liable for indirect, incidental, consequential, or punitive damages arising from the use of our Services, even if advised of the possibility. Our total liability shall not exceed the amount paid for the specific order in question.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Orange County, California. You agree to submit to the personal jurisdiction of such courts.
